- Art. 6 (1) lit. b GDPR (performance of a contract or pre-contractual measures), if your request is aimed at cooperation.

Your personal data will only be stored for as long as this is necessary to achieve the respective processing purposes or as long as there are statutory retention obligations.

 

5. Disclosure to third parties

Your personal data will not be transferred to third parties for purposes other than those already described above. We will only share your personal information with third parties if:

a) you have given your express consent to this in accordance with Art. 6 (1) sentence 1 (a) GDPR,

b) this is legally permissible and necessary in accordance with Art. 6 (1) sentence 1 (b) GDPR for the processing of contractual relationships with you,

c) there is a legal obligation for the disclosure pursuant to Art. 6 ( 1) sentence 1 lit. c GDPR,

d) the disclosure is necessary in accordance with Art. 6 (1) sentence 1 (f) GDPR for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data.

 

6. International Data Transfers

If we transfer your data to countries outside the European Union (EU), we will ensure that an adequate level of data protection is guaranteed in accordance with Art. 44 ff. GDPR.

 

7. Your rights as a data subject

If your personal data is processed, you are a "data subject" within the meaning of the GDPR and you have the right to contact us:

a) to request information about your personal data processed by us in accordance with Art. 15 GDPR. In particular, you can request information about the purposes of processing, the category of personal data, the – 6 – categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data, if it has not been collected by us, as well as the existence of an automated require decision-making, including profiling and, where appropriate, meaningful information on its details;

b) in accordance with Art. 16 GDPR, to request the rectification of inaccurate personal data or the completion of your personal data stored by us without undue delay;

c) in accordance with Art. 21 GDPR, to object to the processing of your personal data that is processed on the basis of legitimate interests in accordance with Art. 6 (1) sentence 1 (f) GDPR, insofar as there are reasons for this that arise from your particular situation or the objection is directed against direct marketing.

In the latter case, you have a general right to object, without the need for a reason arising from your particular situation. If you would like to make use of your right of revocation or objection, an e-mail to contact@martinarink.com is sufficient;

d) to request the deletion of your personal data stored by us in accordance with Art. 17 GDPR, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the establishment, exercise or defence of legal claims;

e) to request the restriction of the processing of your personal data in accordance with Art. 18 GDPR, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you reject its deletion and we no longer need the data, but you need it to assert, exercise or defend legal claims, or you have objected to the processing in accordance with Art. 21 GDPR;

f) in accordance with Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request the transmission to another controller;

g) in accordance with Art. 7 (3) GDPR, to withdraw your consent to us at any time. As a result, we may no longer continue the data processing based on this consent for the future and

h) to complain to a supervisory authority in accordance with Art. 77 GDPR. As a rule, you can contact the supervisory authority of your habitual residence, place of work, place of our company headquarters, or place of the alleged infringement.

We use appropriate technical and organizational measures (e.g. SSL encryption) to protect your data from loss, misuse or unauthorized access.
